Alcohol Rules:

1. Alcohol shall not be sold at any event held on District property.

2. No fees shall be charged for entrance into any event held on District property where alcohol is provided.

3. Proof of Liability insurance is required for the private service of alcohol (e.g., copy of homeowner’s policy). The District must be named as an additional insured and reserves the right to reject any insurance.

4. The District requires that security personnel must be present at all times for any event serving alcohol. The District shall schedule security personnel for the premises. The District shall determine the number of security personnel based upon the number of guest scheduled for the event. The Applicant shall be responsible for paying all cost incurred to provide security personnel. The fee will be due at the same time the Rental Fee and Security Deposit to rent the District’s Activities Building is due.

5. It shall be the Applicant’s responsibility to ensure that no person who consumes excess amounts of alcohol shall drive a motor vehicle while under the influence of alcohol.

6. Minors shall not consume alcohol on any District Property.

IF ALCOHOL IS SERVED AT AN EVENT BY APPLICANT WITHOUT PRIOR DISTRICT APPROVAL, THE DISTRICT BY AND THROUGH ITS REPRESENTATIVES RESERVES TO THE RIGHT TO TERMINATE THE EVENT IMMEDIATELY AND ALL FEES AND DEPOSITS SHALL BE FORFEITED.

INDEMNITY:

THE UNDERSIGNED AGREES TO PROTECT, INDEMINFY, DEFEND AND HOLD THE DISTRICT ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND REPRESENTATIVES (“INDEMNIFIED PERSONS”) FREE AND HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, LOSSES, DAMAGES, COSTS,EXPENSES, DEMAND AND ANY CAUSE OF ACTION OCCURING, ANYWISE INCIDENT TO, IN CONNECTION WITH, OR ARISING OUT OF THE PRESENCE OR USE OF ALCOHOL AT NORTHWEST HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 24 PROPERTY, FACILITIES, ACTIVITY BUILDING, INCLUDING BUT NOT LIMITED TO; 1). SUCH CLAIMS OR DEMANDS ASSOCIATED WITH BREACH OF ANY TERMS OF THE DISTRICT’S RULES GOVERNING ALCOHOL, AND 2). THE AMOUNTS OF COSTS, EXPENSES, JUDGMENTS AND LEGAL FEES INCURRED BY ANY OF THE INDEMINFIED PERSONS ARISING OUT OF PERSONAL INJURY, DEATH, OR DAMAGE TO PROPERTY, WHETHER NOR NOT CAUSED OR CONTRIBUTED TO BY THE SOLE OR CONCURRENT NEGLIGENCE OF INDEMNIFIED PERSONS. THIS INDEMNITY SHALL SURVIVE USE OF THE DISTRICT’S PREMISIES, AND SHALL BE BINDING UPON THE UNDERSIGNED SUCCESSORS, REPRESENTATIVES AND ASSIGNS.
